General Terms and Conditions
For all services of Segwaypoint-koeln.de the following terms and conditions apply. With booking these conditions are considered accepted. Segwaypoint-koeln.de contradicts the inclusion of deviating, general contract conditions by the customer. Tour offers by Segwaypoint-koeln.de are subject to change. Bookings are accepted in person, in writing, by telephone or via the booking form on www.Segwaypoint-koeln.de. The customer is bound to the aforementioned contract offers.
The tours offered generally require a minimum number of participants. The organizer reserves the right to offer the participant an alternative date for an equivalent tour, if on the booked date the minimum number of participants for the desired tour is not reached. A legal claim to start the tour therefore only exists if the minimum number of participants is met. The minimum number of participants can also be achieved with several small groups , eg 3 x 2 people.
Terms of participation in the tours:
- Minimum age 14 years
- Youth between 14 and 18 years old need parents’ permission and signature in the disclaimer
- Youth between the ages of 14 and 18 must be accompanied by a parent or guardian participating in the tour
- Body weight between 45 kg and 117 kg max
- Body height at least 1.40 meters, maximum 1.95 meters
- Firm and flat shoes (no flip-flops or open sandals)
- Permit a valid identity card during the tour
- The Highway Code applies on all tours,
- You need to be in normal physical condition,
- No diseases such as epilepsy, cardiovascular disease, balance disorders or similar.
- Pregnant women are unfortunately not allowed to participate
- You must not be under the influence of alcohol, medication or narcotics
- On site, a disclaimer must be signed
Cancellation and rebooking:
Upon receipt of the booking application, the customer will receive an order confirmation by which the booking becomes valid. In case of cancellation or rebooking the following fees will be charged:
- up to 30 days before the start of the tour, 10,-€ per person,
- from the 30th day before tour start, 50% of the tour price,
- from the 14th day before tour start, 80% of the tour price,
- from the 7th day before tour start 90% of the tour price,
- for no-show or no-show 100% of the tour price,
Please be at the appointed meeting point 10 minutes before the scheduled time and bring your voucher and ID. We will start the safety briefing on time.
If you forget your ID card or miss the beginning of the safety briefing, you will not be allowed to participate in the Segway Personal Transporter (PT) Tour for insurance reasons.
Any vouchers issued will be forfeited.
Segwaypoint-koeln.de is liable for claims for damages, regardless of the legal grounds, in the full statutory amount in the event of intent or gross negligence on the part of its legal representatives or executives. In case of intent or gross negligence of another vicarious agent, Segwaypoint-koeln.de is only liable for the typically foreseeable damage. Liability for consequential damages, such as lost profits or other indirect damages, is excluded in these cases. The above limitation of liability also applies in favor of the employees of Segwaypoint-koeln.de.
The use of the Segway is exclusively at your own risk. Any liability for personal injury and / or property damage caused by the use of the Segway are excluded. The customer has to handle the Segway responsibly and with care and is liable for any damage caused to the Segway as well as any resulting downtime and/or loss of revenue.
Damage to a Segway includes, for example:
- the necessary repair costs, the amount of which can also be determined by an expert opinion
- in case of total loss or theft, the full purchase price plus VAT is to be reimbursed
- Salvage and repatriation costs
- expert costs
- reduction in value (technical & mercantile)
- the landlord incurred failure damage for the duration of the repair, in the case of total loss for the reasonable replacement period
- all incidental costs of repairing the damage
- any downgrading damage to insurance by the landlord
The costs incurred for the repair or replacement of a similar, new rental property shall be borne by the tenant, regardless of any further claims for damages by the landlord. This also applies to non-obvious internal operating damage.
Each Segway has an approval according to the eKFV and is covered by liability insurance.
To ensure driving safety, each customer must have participated in the briefing and driving and safety training of Segwaypoint-koeln.de.
Each tour is accompanied by an experienced guide.
Each customer participates in the tour at their own risk.
Vouchers as well as any remaining credit resulting from them can only be offset against other tours. A cash payment of vouchers is not possible. Vouchers issued for a specific tour can be transferred to another tour at any time. If this tour is more expensive than the one given as a gift, the difference must be paid before the start of the tour. The same applies to value vouchers. The voucher expires after 3 years on 31.12.
Each voucher is impersonal and transferable.
The voucher is to be treated like cash. In case of loss, theft or damage Segwaypoint-koeln.de assumes no liability.
Tour cancellation, termination or shortening:
The tour can be cancelled, aborted or shortened by us due to technical problems, force majeure and bad weather.
Each participant should provide a cell phone number when booking, where he can be reached in the hours before the tour starts. So he can be informed about the cancellation of the tour in time. In coordination with the participant, an attempt will be made to offer an alternative date, depending on availability. The participant has no further claim for damages for the cancellation of the tour, even if the participant appeared on the day of the event and was not or could not be informed about the cancellation of the tour.
We also wish for nice and especially dry weather for each tour date. Please note that in case of rain, the tour will be held as scheduled.
In case of heavy rain, thunderstorms, snow, black ice, hurricane warning, floods or similar, we reserve the right to cancel the booked tour for safety reasons. As far as the tour can not take place due to bad weather conditions and the fixed date has to be cancelled, please make sure that you are reachable by phone for this case.
We will contact you 2 hours before the tour starts if the tour cannot take place due to weather conditions.
Please provide us with a cell phone number where we can reach you 2 hours before the tour starts.
In case of cancellation, the participant will receive either a replacement ticket for another tour date, a voucher or the fare (for voucher redeemers: the voucher) back. He has no further claims for compensation beyond that.
In the event of cancellation or shortening of the tour, there is no right to a refund or a replacement ticket. There is no claim to the tour execution. After the approx. 30-minute briefing, the organizer has the right to decide for safety reasons whether a participant cannot go on the tour (e.g. due to unsafe driving, overconfident driving, overweight, alcohol, unsuitable footwear such as sandals, flip-flops, etc.). In this case there are no claims for compensation.
By starting the tour, the participant agrees that the tour may be cancelled due to safety concerns, misconduct of other tour participants, failure to follow staff instructions or due to other circumstances. In this case, the participant waives the right to a refund of the fare or further compensation.
If a repair becomes necessary before or during the tour through no fault of the participant, the organizer will attempt to provide a replacement vehicle. If this cannot be provided and/or the repair is not possible, the organizer will refund the tour price paid to the passenger concerned. An additional claim for damages by the participant for the downtime of the Segway Tour is not permitted. This also applies to the other tour participants.
Alternative Dispute Resolution
The European Commission offers an online platform for dispute resolution, which can be found here: http://ec.europa.eu/consumers/odr/.
This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer. The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
Place of performance and jurisdiction:
The place of performance is Cologne. The assignment of all claims of the customer against Segwaypoint-koeln.de to third parties requires the express consent of Segwaypoint-koeln.de, unless it is a monetary claim. The place of jurisdiction for all legal disputes in connection with this contract is the court responsible in Cologne, as far as the customer is a merchant, a legal entity under public law or a special fund under public law. Notwithstanding this, Segwaypoint-koeln.de is entitled to sue the customer at his general place of jurisdiction. This contract is subject to German law under exclusion of the International Sales Convention CISG.
Should one or more provisions of these GTC violate mandatory law or be invalid for other reasons, the remaining provisions shall nevertheless be deemed agreed. In place of the invalid provisions, the contracting parties undertake to consider as validly agreed those legally permissible provisions which, according to their economic content, come closest to the originally agreed provisions. Subsidiary agreements, supplements or amendments to these terms and conditions shall only be valid in writing.
The tour price is due in full upon booking confirmation.
Online this can be done by bank transfer or PayPal Plus. For on-site bookings, the price can also be paid in cash, by credit or debit card.
Shipping costs for vouchers
For the shipping of the vouchers we charge a flat rate of 1.90 euros for postage and packaging
The delivery of the vouchers will be made by postal letter or by DHL. The delivery time is 1-2 business days.
